Jack should get going on the grievance. Until then, how can anyone have any sympathy for him during this impasse? The CBA is clear in what should be done in such a situation.

Good thought. But this would be akin to GMTM’s speed up the rebuild by sacrificing some of the future. Let’s do this right and let this play out and get the most possible for him. It’s a marathon, not a sprint. We’re not built for a deep playoff run this year.

Yeah, I don’t want UPL stinking up the joint and leading to continuous losing. I want confidence growing down there, not decreasing. And I agree the game planning would likely change if we have a continued liability in net.

I would think it would be poetic justice if Brisson helped facilitate a trade involving his own son going to the Sabres and we ended up winning the Cup before Jack does. Seriously, the Knight’s window is closing more quickly than we previously though.

I think it depends on whether the insurance company has to comply with the arbitrator’s decision. We know the Sabres will have to, but why would a 3rd party insurer have to? I don’t know, but I’m sure it’s in the fine print of the policy. A grievance would certainly help the Sabres, regardless of the decision. But, they can’t file it, Jack has to and the odds are heavily stacked against him.

On the sample token, we could also do the same thing. Flip an injured unknown for Marner, then turn around and trade a healthy Marner for likely more than we could get for Eichel today.

I wouldn’t be surprised if meatballs is holding them back, then going full sprint at the end. We saw what happens when they go full throttle from the very start, they may get tired.

I’m wondering what the ramifications a filed grievance will have on the insurance situation. The media keeps saying Jack is gearing up to file a grievance and the Sabres are looking to avoid it like the plague. First, I doubt this is the truth. However, are these medical grievance rulings binding? If so, binding to who? What would happen if they rule against the wishes of the insurance company? I don’t think a 3rd party insurance agency would be compelled to follow a ruling of an NHL medical grievance. However, I think someone on here suggested the NHL has a single insurer. If this is the case, they may be more willing to go along with a grievance ruling. And if they are, how could this not be a good thing for the Sabres? That said, I don’t see Jack winning this hearing.

Agreed. We are talking $50M. There isn’t a single individual or family, including Jack’s, that needs $50M to survive or to live a slightly better life. When people argue about the rightful owners of $50M, do you honestly think they are fighting for their livelihood or ability to make ends meet? Or do you think they are thing about their high-end yacht?

At the time Terry signed that contract, the circumstances were much different. He thought he was signing a leader who would lead the Sabres to a SC. How wrong he was. So, at this point, it’s about minimizing money loss. He’s collecting insurance. Some may say it’s smart, some may say it’s greed. Potato, potato. However, at this point, he’s faced with a situation where the next $50M could all be for nothing. Sorry, this isn’t about righting a wrong at this point. Terry could easily sign off on the surgery and say good luck. As @nfreeman hs pointed out, the subsequent liability could easily be dealt with. It’s no public secret that Jack desperately wants the ADR. He’ll have no legal recourse if things go wrong, just put it in writing. So, why exactly why doesn’t Terry allow him to get the surgery then? Is it because he’s worried about Jack’s well being? Not money? You’ve seen the posts about players receiving fusion; it’s pretty bad. At least if he gets the ADR, he could opt to retire with a surgery that is becoming standard for the regular public. In the long-run, the ADR is probably best for him.

Yea, how convenient. Of course you’re right. How silly of me. Back to the greed angle. You think that Terry not wanting to lose $50M had nothing to do with greed. First, let me say I’m not applying any judgement because greed is a basic human emotion. We all experience it, often, myself included. Show me a human who states he/she hasn’t been greedy over the last year (or even month) and I’ll show you a liar. You are taking about the same individual who nixed a better trade return for ROR to save $5M. You’re talking about the same person who fired the majority of his hockey dept in the very middle of a pandemic. But, no, potentially losing $50M on a player contract definitely has nothing to do with greed. Who would care about losing $50M. Again, how silly of me. We’ll just have to leave it at that, right?

Ok. I actually agree with him. He should get the ADR. So if it isn’t about the money and all about his long-term health, why hasn’t he?

Because the responsible thing would be to go get whatever surgery he thinks it’s best. The $50M he could potentially lose shouldn’t any role in this. He has already made enough money for him and his next generation to be extremely comfortable financially. His agents aren’t the ones suggest this, because then they lose a large slice of the pie. Someone has to be the voice of reason.

Wasn’t ignoring that last part at all. (“Who’s potentially going to lose even more money if something catastrophic occurs and the Sabres went against their insurance policy and recommended a different surgery”) Flippant? How else do you want a stranger to act on a message board, financially responsible for someone else’s money? To me, escaping the loss of $50M is almost the same as gaining $50M.

Right now, the insurance company holds all liability. Terry will be receiving his payment soon if he hasn’t already. Now, Terry on Monday can decide that he wants to take all liability. He can cancel Jack’s insurance policy and tell him good luck in the OR. However, I’m never going to fault a business owner trying to maximize his/her profits. So, going against insurance’s advice would be a very poor business decision. This is what Jack’s agents are trying to do. However, for Jack, he is going about this as a business decision as well, when in fact it should be a personal decision. He’s the one with the broken body. He’s the one who’s going to have to live with any consequence of surgery. Therefore, he should do what is best for his long-term health. But, his mind is being clouded by $50M reasons. I don’t blame his agent for doing what is best for their interests, but where are Jack’s parents in all this?
