The couple websites I looked at for Texas law said that an open container on its own is not arrestable. But couple with another violation, they can arrest you. If he was in fact going that fast, there's the other violation that they need. The open container is the crime, so they have the green light. If those two details are true, open container + driving nearly double the speed limit, I have absolutely no problem with searching the car. The law might saw otherwise, particularly in Texas, but we'll see. edit: @LGR4GM, the beer glass acknowledgement of your post seemed too appropriate here.

There's a state trooper (maybe a different department, can't remember) over on the Bills board who usually chimes in on thread like this. I might skim through their thread to see if he's said anything. He's usually pretty interesting during these topics. They definitely don't need a warrant. It goes right back to the whole probable cause discussion. There's just so much gray area there that Saul Goodman can usually walk all over it.

I don't know Texas' laws on open containers (that's where he is, right?), but the open container in plain sight seems like it should be enough for probable cause. Actually, after some googling, the combination of the open container and the speeding makes it an arrestable offense.

The initial report in here said he had an open beer between his legs. Has the story changed since then? If that report is accurate, wouldn't that be more than enough reason for any search?

I wonder if this is even legit. Any story out there links back to this Swedish paper. The whole thing seems a bit off to me. If anything, he might be a guy who would be getting an AHL contract.

And it was probably tucked away somewhere in the car. No less illegal, but I doubt he's drinking with that thing in a holster or tucked into his waste band. I'd imagine that these are the types of things that get plead down instead of it turning into a Plaxico Burress situation.

That's the only way it can happen today now that there are so many teams. It's funny, I'm actually more curious right now about some of the older ones. As you can imagine, Edmonton had quite a run, 5 all stars drafted between 1979 and 1980, 4 of them hall of famers. Those were their first two drafts, so talk about hitting the ground running. Then they added another all star/hall of famer the following year

Three future all stars seems like an odd designation. With those rosters turning over constantly each season, only three teams pulling that off seems incredibly low. Now if it was supposed to be hall of famers, now that seems like it could be doable. Buffalo almost hit that one with the Housley draft. Could the real question be about the first and second team all star awards instead of the actual all star game itself? As for the all star version, did each of these three play in one of those games? It's tough to tell especially in more recent years as less guys can get in from one team.

I've been in NC for 6 years now and I haven't actually tried it. I think the sweet tea scared me off from the favored local drinks.
