You are missing the crucial element here. The 17 yo demarcation is based on the premise that someone under 17 yo does not have the maturity to consent to adult activity and should be protected. individuals over 21 are assumed to have that maturity and therefore are liable for their actions. The parents are irrelevant.

Statutory anything in the law are bright lines. A determination is made that the conduct, in this case sex with a person under 17 years of age with someone over 21 years of age will not be tolerated. it is an offense by statute, hence the term. It eliminates all the "ifs" in your post. Element 1 did sex occur? element two? what were the ages of the parties at the time it occurred. Formulaic. As Eleven indicated, anything else would be held for the sentencing phase but some states even prohibit the introduction of mitigation in these cases.

S 130.25 Rape in the third degree. A person is guilty of rape in the third degree when: 1. He or she engages in sexual intercourse with another person who is incapable of consent by reason of some factor other than being less than seventeen years old; 2. Being twenty-one years old or more, he or she engages in sexual intercourse with another person less than seventeen years old; or 3. He or she engages in sexual intercourse with another person without such person`s consent where such lack of consent is by reason of some factor other than incapacity to consent. Rape in the third degree is a class E felony.

I applaud the exercise of discretion when hesitating to divulge allegations until some confirmation of source and or public announcement is made. The twitterverse is rife with retweeted statements from which the reader is encouraged to infer the veracity of the underlying facts. Although a "PK has been requested to provide information to the police" statement would have sufficed if independently verified. Keep digging Hoss, and report facts.. No one can or should ask for more.

At 21.we.could have gotten a left d. Will he make it who knows. Will Lehner make it? Who knows? But I think gt is still moee overrated than selecting a prospect in a deep draft. To each his own.

Your respect is appreciated. Nice to know some things don't change. My position is that gt is highly overrated. The Hawks made Niemi and not vice versa. If you are loaded up front goaltending can be average and you still can win the prize. Gt is overrated. Clap clap clap clap.

In the OP's defense there was considerable talk of shipping prospects or trading the 2016 1st pick for a left handed D. And that was trade the pick now talk. I think X (Eggs?) summed up my thoughts, when he stated that his expectation for next year was that they would be better than last year. That's it. We are still rebuilding and I was firmly against the Lehner trade for what it cost. Not because he is not a potential starter, but rather that is the least of our issues while we rebuild.

All true rod and gun clubs have patches or buttons with their insignia on them. It allows other members to know that a person hunting or fishing on club property is there rightfully. plus they look great in the rear window of a truck. We need an insignia,logo patch whatever. Perhaps you can "motivate" your significant other to aid in this project. :w00t:

Kane, Ennis, Bogosian, O'Reilly, Gorges, Murray, Bylsma. We have no need for Briere nor does he fit, nicely or otherwise. If there is a spot on the forth line not filled by Larson, Legwand Foligno then we will be looking to Rochester for that help in the form of Schaller or otherwise.

My girlfriend doesn't quite get my addiction to steelhead. Fortunately, I found the Gray Drake lodge on the Muskegon River. Run by Matt Supinski originally from WNY. She sips wine in front of the fire and I fish. Ice or no ice. Love that first run!

Congratulations Weave. The new Mitchell's are nice but the older ones are bullet proof. And those Panther Martins are gold. Tough to find the black tails and they are crack to trout. Tight lines.

The resistance of the cap on a spin casting reel reduces distance. Although in many cases distance is overrated, as in most things accuracy is more important. I have Shimano spinning reels that I use for pike, muskie and walleye. However, I am a convert to fly fishing and feel it is the most fun and efficient way to catch fish in moving water. NY is blessed with some great trout water including the Genessee from the PA line to Belmont. Catherines Creek, Wiscoy, Ischua and others are great trout water. The Black River is also a dream. PA though has some of the best trout fishing east of the Mississippi. And those of you in the Rochester area can catch steelhead and Atlantic Salmon in the Genny. Remember trout don't live in ugly places. Personal taste varies, but trout really don't have much of a taste per se. The big lake run browns are best smoked (over say 6 lbs.) There are some brook trout streams in and around Rochester with brook trout in them. Any size over the limit is good eating. Brook Trout are not actually trout but from the char family and are great pan fare.

The Sabres will not have to manipulate the roster lkme last year to be in the lottery discussion. If they stick to the plan of letting the youth season in the National, we will experience rookie/inexperienced foibles from time to time. I think that is GMTM'S plan and has been all along. We are not a FA destination and may never be and he knows that adding that next piece will have to come through the draft. That may be a player for the roster or a player to trade for a roster player. -
I like that pairing as well.

I think the right partner will go a long way towards him reaching his potential. The things he does well, he does very well (i.e. physical play zone clears, getting shots through.) Complementing his strengths with someone whose strengths bolster his weaknesses ( over aggressiveness, pinching) is the recipe. See Seabrooke/Keith or Hedman/Stralman. Maybe not Norris but solid top 4.
