Eichel himself is 100% legally allowed to share his own medical records with anyone he pleases. HIPAA doesn’t apply here. The thing that confuses me is why he didn’t do this from the very beginning. -

Dr Friedman has it wrong. If there was nerve impingement, this is a indication for expedited surgery, not something you wait on for 8 months. -

They pay the physicians who have examined Jack, so are not unlike a 3rd party payer, who is a HIPAA-governed entity. I’m sure there is language within the CBA in regards to this. However, this is a moot point, because if Jack wanted to get traded, he would easily just sign a HIPAA release form. Poof, other team physicians would have his records. -

Can we have a poll asking whether Jack should assume full financial responsibility (ie risking his contract) for a surgery he is choosing over multiple medical opinions?

You forgot John. He has the authority to go get any surgery he wants. There may be some consequences, but he certainly has the authority to do what he wants to his body.

Here’s the thing. It may not become readily apparent the ADR surgery was a success or not. Sure, if the patient survives without any complications, then the surgery was a success. But what happens after a year or two when/if we realize Jack never really regained his former dominant self? We never authorized the surgery, so can we then void it? Or, let’s say he’s playing lights-out, but 1-2 years post-op he sustains a mid-ice hit and the ADR dislodges and his career is done. Can we void it then, or do we still owe Jack 30-40M?

I think we’re overstating Eichel’s worth to the sports world here. He plays for the least popular team in the least popular major sports league. And he’s not the face of the NHL either, not even close. Given his injury history, I wouldn’t even put him in the top 20 players.

Agreed. The thing I’m hung up on is why other teams don’t already have his medical records. Unless there is some weird CBA clause, a patient can request, review, and copy their medical records at any time. With a copy in hand, they can also distribute them out to anyone they please. Patients are not bound by HIPAA. So, again, unless their is a weird CBA clause, it seems like Jack’s camp is the one who are hiding things.

In essence, this is the same as trading away picks. Can’t see us doing that considering we are trying to do the exact opposite with Jack.

I’m not understanding “there must be a trade” worked out. Brisson just started less than a week ago. Doubt things would’ve changed that dramatically. Brisson is probably a smart guy though. What has likely happened is that he knows (and has made Jack realize) that there is no market for an unresolved career-threatening injury for a guy owed $50 million. This is obvious, otherwise he would’ve been traded by now. So, he told Jack to put his big boy pants on and get a procedure done. The quicker he shows that he’s not damaged goods, the quicker he will get out. Sitting on your hands hoping KA would cave was a failed mission.

I’m not sure what role agents play in trades, besides demanding one. They don’t change who is negotiating. The lawyer analogy is weak sauce because lawyers are the ones pleading cases. In our justice system, this can mean the difference between a guilty or innocent verdict. It doesn’t matter what Fish or Brisson pleads or believe. Neither of them have to live with the consequences of trading away a league star or top prospects. -

Agreed. We don’t know Jack’s injury status or whether he could play right now or not. That’s not a situation that can be altered either way by changing agents though. Adams has made it abundantly clear as to what he wants back in exchange for Jack. I assume (I would like to believe) that if such an offer was in the same ballpark as the ask, the trade would have been successfully negotiated. But, it hasn’t. Instead, we are reading in the media about how Adams is asking for the sun and the moon. I hope you’re right about Brisson, but it’s a little bit too smoke and mirrors for me at this point. I hope he has the relationship or clout or some other intangible je ne sais qoi with other GMs. I doubt it’s going to change Adams mind though.
