No regulation is an infringement, but from what I remember reading those two exceptions, criminals and mental incompetents, infringements serve an overiding public interest and those convicted no longer have right or competence of full citizens.

No you misunderstand the role of gov. Even the court. The Supreme court affirmed the distinction in the two clauses, not the right, which was established by the constitution. The legislature writes the legislation, the admin writes the implementing rules and the court interprets that those rules meet the standards of the legislation and enforce those rules
