  9. No regulation is an infringement, but from what I remember reading those two exceptions, criminals and mental incompetents, infringements serve an overiding public interest and those convicted no longer have right or competence of full citizens.

  11. "Shall" is the problem from a legislative legal standpoint it is ironclad, infringed has a little more wiggle imo but not much. And crime conviction and mental illness seem to be the only things agreed okay to infringe on the right. Still gun advocated arent backing down and until people like deluca insist on a ban on all, and those equally vocal on the other side, there will be no common sense compromise achieved.

  14. Nice article Neo and despite my desire at different times of my life to get rid of guns and at others thinking there is a need, I havent yet figured away judicially to actively get around the second amendment that can pass legislative action or stand judicial scrutiny.

  20. Oh I agree there needs to be a narrowing of scope of what the amendment allows, but that is the problem it can't be done by administrative or legislative fiat, bit only by amendment. Otherwise our joke of a healthcare insurance system would be regulated by feds not state legislatures, who are bought off by state incorporated but umbrella laiden insurance cos, to avoid the interstate commerce clause.

Short of a constitutional amendment i am sorry to say you are sol That being said, part of ensuring "a free state" is the preservation of the "right to bear arms" and "shall be unabridged" That part is true, the reason for the right has been eliminated, that being said the right still stands as a separate clause and there in lie the problem outdated or not.
  22. No you misunderstand the role of gov. Even the court. The Supreme court affirmed the distinction in the two clauses, not the right, which was established by the constitution. The legislature writes the legislation, the admin writes the implementing rules and the court interprets that those rules meet the standards of the legislation and enforce those rules
