The juror who spoke last night disagrees that the facts supporting acquittal were overwhelming. She said the initial vote had 1 for murder, 2 for manslaughter, and 3 for acquittal. Hardly indicative of overwhelming evidence. I think the politics came in heavily on the decision to charge murder, rather than manslaughter. Could this have been the actual events: Zimmerman approaches Martin, Martin tells him to "F*#K Off" and turns to walk away, Zimmerman grabs him by the shoulder to get him to stay put and wait for police. Martin takes exception to being touched and attacks Zimmerman. Martin overpowers Zimmerman and gets him to the ground. Zimmerman reaches for his gun and shoots. Are there any facts that contradict this proposed timeline?

I thought they didn't need to, that the law prevented the prosecution from proposing that Zimmerman could have walked away at any moment. It's not an affirmative defense, it negates a prosecution tactic.

From the statute: absolutely they did. It is a key part of the self defense statute in Florida. which is the primary reason for acquittal.

I would add that we see it through the prism of the historical experience communicated to us as well as our own experiences. And to the bold, this is exactly my conclusion. We should not be attempting to eliminate this type of bias, I don't think we can, we should be attempting to recognize and deal with it.

Think back to your expected outcomes from the Corasanti Verdict and this one. Or the Casey Anthony verdict. The result of our predictive calculation comes to the front, but the bias takes place outside of our conscious control. Maybe subconscious was the wrong term.

I'm not denying the existence of conscious bigotry, I'm pointing out that even people who try not to actively discriminate against others are subconsciously hampered by the combination of institutional memory and the human facility to examine circumstances and predict an outcome based on those memories. That those memories are tainted by stereotypes created to degrade from a history written by the powerful only exacerbates this phenomenon.

This is why it's subconscious. I am certain that if it were a white perpetrator and a white victim the idea of riots would never have come into your thoughts. Think about the Corasanti verdict last year.

See, this is the silent racial bias in this country. 20 years ago a man was brutal beaten on camera by 4 cops who were subsequently and inexplicably acquitted of wrongdoing in a city with a documented history of police discrimination. The result was catastrophic. 20 years later, we fear a similar outcome every time a verdict is released in a case with a white perpetrator and a black victim. I am not accusing you of anything, I get the same thoughts. We as humans have a survival mechanism where we view a situation, remember a similar situation in the past, and predict an outcome. Because we have memory of a violent racial interaction, we automatically predict similar outcomes when similar situations arise. Regardless of the cause, however, this sub-conscious bias is real and potentially harmful and we should be aware of it.

The lowest scoring team NEVER makes the playoffs. GGA is important, but if you can't score, it doesn't matter. They need goals worse than we do.

I'm really glad I wasn't on that jury. Criminal trials are terrible corollaries for broader social issues, be they guns or race or whatever. 6 People had to look ONLY at the information presented in court and come to a unanimous decision in a system purposefully tilted to protect the accused.

what was Kovy's WAR last season? They were 1-6-4 without Kovy last season. And that was WITH Marty healthy.

This is not a completely bad thing for the Devils in the long run. If he had retired in say 8 years (age 38 and his salary drops to $1M), the Devils would have had a cap penalty of about $6M per year for 5 years. The contact was a ticking time bomb the moment Recapture was added to the new CBA. Cap recapture still applies.
