  1. Currently listening to tenBBC's Football Daily podcast. Louis Van Gaal Is actually Andy Kauffman. I swear. If he can spend more than a quarter of a billion dollars on players and still have nothing better than "hoof it towards Fellani" then I might as well be in charge. He's lucky Liverpool and Chelsea are also dumpster fires currently. Interested to see what Arsenal do before the window closes. I think it's either City or Arsenal this year. Probably City, but we (I) can always hope...

    This brings back vivid memories of one of the worst incidents I've personally witnessed at a sporting event. Bills -Patriots 11/9/97 (looked up the date and score) Pats won 31-10. Todd f***ing Collins. Went with a group from Bonaventure. We were in a corner. Ten rows in front were a bunch of Pats fans. One decked out in all-Pats gear, waving a Pats flag. A rather large one. When they scored, he'd pull down his pants and do a dance in his Pats boxers. I think you can see where this is going.

     

    The folks behind us started tossing stuff down in the middle of the fourth quarter. Inevitably, a girl sitting near them, not with them, got clocked in the back of the head with a full beer can. The Pats fans took off. The brawl still happened. Between the Bills fans below us and the Bills fans above. Not pleasant. Probably commonplace, but I just remember thinking: "What the hell is wrong with people?" I've since learned that there is no answer to that question, there are many things wrong.... But seriously, please be good this year Bills....

  3. Great Lakes Brewing Co. (At least 4 varieties) now available here in Roanoke. Saw it in a local store yesterday, asked the clerk behind the counter when this happened. She advised me it's been two weeks, they had some sort of event to mark it. Then I saw it in Kroger this morning. I love Great Lakes, had our wedding reception there.

     

    Hopefully in the next month or so Christmas Ale makes it down here. I will buy any and all of it I can find.

     

    On another note, anyone into Flying Dog Brewery? Half-decent beer, tried the imperial porter recently. Good stuff. Also, artwork by Ralph Stedman so you know it's good...

Not a good look.  I, and I'm sure the other lawyers on this board, have been subjected to many CLE sessions dealing at least in part with social media.  Here's the rule to follow when tempted to take to the internets on sensitive subjects involving, or even potentially involving your clients (when not making well thought out and proofread statements for a specific purpose that aren't knee-jerk reactions to something you read in the paper no matter how stupid it may or may not be): NO. 

  5. I think both of those jersey designs are hideous.  Orange?  Blech.  And that shade of blue and red really don't compliment each other well in large patches.  Turd burgers, the both of them.

    We can at least be thankful the 90's are well and truly over and they're not black.

  6. Murder is black and white. Rape is sometimes a grey area of he said she said, where it's sometimes difficult to know who to believe if and when the line was crossed from sex to rape. I'm not justifying rape, just the reason why it's not as clear as murder.

    In the sense that someone is either dead or not you're entirely correct. Both have many prosecutorial hurdles to clear. The dead can not testify as to what happened, whereas rape victims can. The dead do not have to (be alive while) they are disparaged, demeaned, re-live the incident ad infinitum, (be alive while) their families hear the sordid details of their past put on display as of it were dispositive in the present instance.

     

    I admit that it is, of course, possible that a false accusation can be made. Make no mistake, however that history / current societal norms tells us that rape / sexual assault is a problem. A large problem. An underestimated problem by wide swaths of the populace. Men and women. No crime can be more heinous than the destruction of the control over one's body by another. Leaving them alive to deal with it afterwards is no positive in the long view, and should be punished no less severely. Which is exactly why rape is "on a pedestal"

  7. Wrestling with this issue. (And by no means do I mean to diminish anyone's perspective here.)

    Rape is an awful crime, but I am somewhat disturbed with its pedestal at the moment.

    I know someone raped and murdered.

    The murder half seems the harder part.

    Rarely are women told that they have somehow invited or deserve to be murdered, or failed to act in a manner that would prevent their own victimization. As if it mitigates the responsibility of the individual actually doing the violent and dehumanizing act.

     

    Can't really say the same about rape.

  8. Am I the only one who finds the Kings' behavior in handling the Voynov situation and now Richards horrifying?

     

    One of them hasn't so much as been charged with a crime yet and they move to axe him because his contract is unfavorable and he has little to offer from a hockey sense. The other has now been convicted of a domestic violence offense. Before that, in a tone deaf move borne of sheer ballsiness he was, at least on one well-publicized occasion "definitely not practicing with the team, nope, just out for a skate."

     

    They were ticked at the NHL, and it's the league, as far as I'm aware, that has levied his suspension on him. The Kings, I think, were rather loath to do it since Voynov can still play hockey once he's out of jail... I hope it's not for the Kings, but I don't know that I'd put it past them....

  9. If I had to guess, Kane met a mature looking 17 year old who snuck into the bar. They fooled around and now Kane's in trouble. If that is the case I doubt he's given more than a fine and probation seeing as he has a high end lawyer and the victim would be guilty of fraud, and likely underage drinking.

     

    If it was a legit rape however throw the book at him.

    Wait, what?  "Legitimate Rape" rears it's head again.

     

    Sex - Consent = Rape.  It's called "The age of Consent" for a reason.  Below it, there is and can be (legally) no consent to sex with someone over 21.  It's a strict liability offense.  It doesn't matter what she did or didn't do.  And she'd have to be 16 at most in any event since the statute as repruduced above clearly states LESS THAN 17.   Legalistic, I know, but words have meanings and all.  A 16 year old girl is by definition (in NY) a rape victim if one engages in sex with her.

     

    Now, all things must be taken into context and if were a case of PK diddling a completely willing underage girl that would be one thing. The way this is brewing makes me think there's a bunch more to the story.  And not knowing any facts at all, I'm merely surmising that it's gonna be bad.

    Nice Mitch Hedberg reference.  Sadly, he did so many drugs he now only used to do them. 

     

    Speaking of which, the emphasis that the Feds and local governments have placed on prescription narcotics is quite something.  I work in the court system in VIrginia, and can tell you from my own observations and what I've been told by law enforcement that heroin is definitely cheaper and easier to get than Oxy et. al.  I'd be willing to bet the same is true more or less universally across the US.  Immensely frightening if you think about it. 

  11. Yes, sir. We are fellow swill drinkers. I like Labbatt Blue and Molson except that they are more expensive down here (NC) so I stick with the cheap stuff and usually only drink those when I'm up in NY or I'm at the Canes arena and can find the Labbatt cart/line since everything is overpriced in the arena anyway so I might as well drinking something I don't normally get if I'm going to overpay anyway.

    $9.99 for a six pack of Blue at a local chain grocery store here in Virginia yesterday. I'd like the occasional nostalgic taste of home / high school but sheesh. Ended up going with the IPA from the brewery that is closer to my house than the store was. Because of course I did.

     

    Oh, and does anyone actually think for a second Eichel is anywhere but Buffalo come October? I can think of no legitimate reason why not... Unless McDavid pulls a Lindros. Which would be hilarious but not happening.

  12. I also shudder to think what a 24-year old Jim Kelly (just for instance) would have done with Instagram while king of the USFL or when he first got to Buffalo.

    How about a 24 year old [insert name of just about 1000 great/good/alright players of the past here]?  Not saying he'll be great by any means, but I think some slack should be cut.  From all accounts, Winnipeg was a toxic experience for him, for a variety of reasons.  Some his responsibility, others most definitely not.  It'll be interesting to see what he does with a fresh start.

    Hey, the Corolla I destroyed went strong for 11 until I ill-advisedly made it stop forever.  From what I've been able to read and observe, I have no confidence that remains true.

    I totaled my wife's 2005 Corolla Saturday.  Spent Monday and Tuesday car shopping.  My wife wanted another Corolla; having researched it a bit I'm glad we didn't.  Of course, my guilt over ruining her beloved car (the first new one she ever bought, becasue of course it was) led me to agree to let her pick out a brand new Honda H-RV.  After not having had a car payment in forever, let me just say: F************************************k.  Complaint over.

     

    But seriously, what has happened to Toyota?

If the Sabres were to someday win the Cup, I'm fairly certian all of the children flinging toys out of strollers charged with covering the team for the Buffalo News would immediately be filing reports chastizing the team for winning in 6 instead of 5, or that the players were reckless with the champaigne in the dressing room and someone got wet.  Not that I'm holding my breath, but still... 

     

    I just read the BN coverage of the team when i need a laugh.  I have a hard time imagining anyone with a brain taking them seriously.  Hoppe is a setp up, and I'm well aware of his history here...

The idea that the Arizona game was just what this team needed to flip that switch which turns them into world-beaters (that they obviously have had in thier possession all this time and are just getting around to using now) is nuts.  They're professionals, they should want to win every game.  They should be dancing in the locker room after not winning in forever.  Must have been an incredible feeling for those guys.

     

    They're also not very good.  Certainly not when viewing the sum of thier parts, quite intentionally constructed as such.  Oustide those guys with long-term contracts (minus Hodgson) and the top prospetcs, everyone in that room should know they'll be tossed aside as soon as possible and replaced with someone better.   I don't think the situation is or should be lost on a single one of them.  Weber aside (and I suppose Neuvrith on his way out the door), nobody has been throwing toys out of strollers.  They have to get it, right?

     

    Still, two weeks from now this will be mercifully over, one way or the other...

  17. I find it hilariously precious of Mike Weber, the player whose stupid penalty decided this game, to go to the media and say that the problem is the fans aren't good enough. The Buffalo News can clutch their pearls and faint all they want, and evidently they have a few fifth columnists (see what I did there?) in the room, but the organization took this direction and is seeing it out. 2/3 of this roster will be nowhere near the Sabres in three years. Teams have been blown up and rebuilt before ... Admittedly to varying degrees of success. Those chastising the Sabres for doing what others have done repeatedly are only vilifying them because of the possible rewards. We're we not talking about a generational talent / talents in the draft then the annual stripping of franchises to the studs we see would pass unnoticed.

     

    The idea is to win the cup. Hell, multiple cups. Wasn't going to happen this year regardless, but this year's awful will fertilize future greatness (hopefully). Mike Weber will be long gone by then. He'd do well to keep that in mind.

    Every year I get Great Lakes Christmas Ale. This is by far the best seasonal beer in my opinion as I'm not crazy about many of them.

     

    Oh you've just reminded me of one of the three reasons I miss Cleveland.... Christmas Ale is, quite simply, the best holiday beer ever (that I've consumed).

     

    I lived in Ohio City for a few years, within drunken stumbling distance of Great Lakes Brewery... In fact, had our wedding reception there. Ah, to be young and childless again...

     

    They make a ton of good stuff, the Edmund Fitzgerald porter and Blackout Stout are my favorites, but I like dark beer more than most...

  19. I find nothing wrong with this assessment. The labor unions have practically priced themselves out of the market, and have actually been the #1 reason why companies go out of business.

     

    Bethlehem Steel, anyone?

     

    The unions are only part of the problem. They had their time and place, and if operated in a sane manner, would still matter. Essentially, they are the hagfish on the bloated carcass of the American worker. (having metaphorically died and hit the sea floor).

     

    The worker, of course, was killed by capital. Capital, in a democracy, can not achieve its means without the collaboration of labor, to the detriment of labor. Keep voting for those upper-class tax cuts, middle-class. You're likely to have your job outsourced in recompense.

    What is it about America that while we preach at each other about the land of opportunity and social mobility, we do everything in our power as a society t o ensure those things are complete lies.

     

    Honestly, it shocks me that people can look at the nominally generous benefits (in exchange for less than market-value pay and the opportunity to pay for union membership that 75% of members will never benefit from directly) and think the following:

     

    "Those people have it better than I do..." this is not the socking part yet..."screw those people ###### better, I will embrace a political view making life worse for them, instead of working to make life better for myself."

     

    Flame away, you know I'm at least factually correct.

  21. job satisfaction. if you're not happy where you are, move on. life is way too short to spend x number of years not liking the job or company. i did that for almost 5 years. the day i quit, it felt like there was a weight lifted off my shoulders that was indescribably awesome. the day i started my new job was even better.
